By accessing or using the Unite Patient Store ("Store"), operated by Unite on behalf of Total Joint Specialists ("TJS"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Store.

These terms apply to all visitors, users, and customers who access or use the Store. We reserve the right to update these terms at any time, and your continued use of the Store constitutes acceptance of any modifications.

2. Products and Services

The Store offers recovery products that may be recommended by your healthcare provider. These products are:

  • Optional: All products are suggestions, not requirements for your care.
  • Informational: Product descriptions are for informational purposes only and do not constitute medical advice.
  • Subject to availability: Product availability, pricing, and specifications may change without notice.

Always consult with your healthcare provider before using any recovery products. The Store does not provide medical advice, diagnosis, or treatment.

3. Ordering and Payment

When you place an order through the Store:

  • You represent that all information you provide is accurate and complete.
  • You authorize us to charge your payment method for the total order amount, including applicable taxes and shipping.
  • We reserve the right to refuse or cancel any order for any reason, including suspected fraud or product unavailability.
  • Prices are displayed in U.S. dollars and are subject to change without notice.

Order confirmation does not guarantee product availability. If we cannot fulfill your order, we will notify you and issue a full refund.

4. HSA/FSA Eligibility

Many products in the Store may be eligible for purchase with Health Savings Account (HSA) or Flexible Spending Account (FSA) funds. However:

  • Eligibility depends on your specific plan and IRS regulations.
  • We do not guarantee HSA/FSA eligibility for any product.
  • Consult your plan administrator or tax advisor for eligibility questions.
  • Keep your receipt for potential reimbursement documentation.

5. Shipping

  • Shipping times are estimates and not guarantees.
  • Risk of loss passes to you upon delivery to the carrier.
  • Free shipping on orders over $95 (before tax).

6. Returns and Refunds

  • Returns accepted within 30 days of delivery, subject to the Return Policy.
  • Products must be in original, unopened packaging. Returns are not accepted if opened.
  • Returns are for manufacturer defect; worn or used products are not eligible.
  • Perishable items are not returnable.
  • Manufacturer defects are covered for 30 days from receipt.

7. Intellectual Property

All content on the Store, including text, graphics, logos, images, and software, is the property of Unite or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

8. Limitation of Liability

To the fullest extent permitted by law:

  • The Store, Unite, and TJS shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability shall not exceed the amount you paid for the product(s) in question.
  • We make no warranties, express or implied, regarding the products' fitness for a particular purpose.
